TERMS AND CONDITIONS OF SALE

2. Scope

These Terms govern the use of aleauni.it and purchases made through the online store. By placing an order, you confirm that you have read and accepted these Terms, the Privacy Policy, the Shipping Policy and the Return and Refund Policy.

Nothing in these Terms limits rights granted to consumers by mandatory applicable law.

3. Products and sizing

We make reasonable efforts to describe and display each garment accurately. Colours may vary slightly depending on the screen, lighting and photography. Natural variations in fabric, texture, print placement or finishing are not defects where they are inherent to the material or production process.

ALÉA UNI garments are offered in One Size unless otherwise stated. Measurements and fit information are indicative and may vary slightly between styles. Please review the product information or contact us before ordering if you need assistance with fit.

4. Orders and contract formation

Product presentation on the website is an invitation to place an order, not a binding offer. After checkout, you will receive an electronic acknowledgement. A sales contract is concluded when we confirm acceptance of the order or dispatch the goods, whichever occurs first.

We may refuse or cancel an order before dispatch for legitimate reasons, including lack of availability, an evident pricing or product error, suspected fraud, or inability to authorise payment. If payment has already been taken, the relevant amount will be refunded without undue delay.

Please review your order and contact details before confirming payment.

5. Prices and payment

Prices are shown in the currency selected for the relevant market and include VAT where required. Delivery charges and any other applicable costs are shown before the order is submitted.

Available payment methods are displayed at checkout. Payments are processed by Shopify Payments, PayPal or the selected payment provider. For manual bank transfer orders, the order is processed only after cleared funds are received. You are responsible for using an authorised payment method and providing accurate payment information.

For deliveries outside the European Union, import duties, local taxes and customs charges may apply unless expressly shown as included at checkout.

6. Delivery

Available destinations, delivery methods, charges and estimated times are shown at checkout. Orders are usually delivered within 2–5 business days after the order confirmation email.

Delivery estimates are not guaranteed where delays result from customs, carrier operations, public holidays or circumstances outside our reasonable control. Further details are set out in the Shipping Policy.

7. Right of withdrawal and returns

Consumers purchasing online may withdraw from the contract without giving a reason within 14 days from the day on which the consumer, or a person designated by the consumer, receives the last item in the order.

To exercise this right, submit a return request through your customer account or send a clear statement to sales@aleauni.it before the deadline. The goods must then be returned within 14 days of communicating the withdrawal.

The customer bears the direct cost of a change-of-mind return. We refund the payments due under applicable law, including the cost of our least expensive standard delivery option. We may withhold reimbursement until the goods are received or evidence of return is provided, whichever occurs first.

The customer may inspect the garment as they would in a store and is responsible only for diminished value caused by handling beyond what is necessary to establish its nature, characteristics and fit.

The statutory right of withdrawal does not apply where a legal exception applies, including garments made to the customer’s specifications or clearly personalised. Sale and promotional items remain covered by statutory consumer rights unless a specific legal exception applies.

8. Cancellation requests

You may request cancellation through your customer account or by contacting sales@aleauni.it while the order remains unfulfilled. We will make reasonable efforts to stop processing, but cancellation cannot be guaranteed once fulfilment has started. If the order cannot be cancelled, you may use the statutory withdrawal procedure after delivery.

9. Faulty or non-conforming goods

Products are covered by the legal guarantee of conformity provided by applicable consumer law. If an item is defective, damaged in transit, incorrect or otherwise non-conforming, contact sales@aleauni.it with the order number and supporting photographs where relevant. Remedies available under mandatory law are not affected by any commercial policy.

10. Website use and intellectual property

The website, brand names, logos, photographs, designs, text, graphics and other content are owned by or licensed to ALEA SRL and are protected by intellectual property laws. They may not be reproduced, distributed, modified or commercially exploited without prior written permission, except as permitted by law.

You must not misuse the website, interfere with its security or operation, transmit malicious code, attempt unauthorised access, or use the website for unlawful or fraudulent purposes.

11. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or breach of mandatory consumer rights.

Subject to mandatory law, we are not responsible for losses that were not reasonably foreseeable when the contract was concluded, or for business losses incurred by a consumer. Nothing in these Terms affects the legal guarantee of conformity or other non-waivable rights.

12. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control. If such an event materially affects an order, we will contact you and take reasonable steps to minimise the impact. Your mandatory rights remain unaffected.

13. Privacy and cookies

Personal data is processed in accordance with the Privacy Policy and applicable data protection law. Cookie choices can be managed through the cookie consent tools available on the website.

14. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer resident in another country, you also retain the protection of mandatory consumer provisions applicable in your country of residence.

For consumers, any dispute may be brought before the competent courts determined by mandatory consumer law, including the courts of the consumer’s place of residence where applicable. For transactions not involving a consumer, the courts of Rome, Italy shall have exclusive jurisdiction, unless otherwise required by law.

15. Changes

We may update these Terms to reflect legal, operational or service changes. The version applicable to an order is the version in force when the order is placed. Material changes will not apply retroactively to completed purchases unless required by law.
